By accessing or using CloudPork's services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services.

These Terms apply to all users of CloudPork, including but not limited to individuals, companies, and organizations that access or use our infrastructure cost analysis platform.

CloudPork provides AI-powered infrastructure cost analysis services, including but not limited to:

• Cloud infrastructure cost optimization recommendations
• Codebase analysis for cost efficiency
• Scaling cost projections and forecasting
• Executive reporting and cost intelligence
• Local, cloud, and hybrid analysis options

You may be required to create an account to access certain features. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and current information
• Notifying us immediately of any unauthorized use

You agree not to:

• Use the service for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble our software
• Use the service to compete with CloudPork

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your data. By using our services, you consent to our data practices as described in our Privacy Policy.

For Enterprise Local Analysis, your code remains on your premises and is never transmitted to our servers. For Cloud and Hybrid analysis, data is processed according to our Privacy Policy and security standards.

Paid plans are billed in advance on a monthly or annual basis. You agree to:

• Pay all fees associated with your subscription
• Provide current and accurate billing information
• Notify us of changes to your payment information

We reserve the right to modify pricing with 30 days' notice. Refunds are provided according to our refund policy.

CloudPork owns all rights, title, and interest in our services, including all intellectual property rights. You retain ownership of your data and code submitted for analysis.

We grant you a limited, non-exclusive, non-transferable license to use our services according to these Terms.

CloudPork provides cost analysis and recommendations based on available information. We do not guarantee:

• Specific cost savings or performance improvements
• That our recommendations will be suitable for all use cases
• Uninterrupted or error-free service

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

IN NO EVENT SHALL CLOUDPORK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Either party may terminate these Terms at any time. We may suspend or terminate your access to our services immediately if you violate these Terms.

Upon termination, your right to use our services will cease immediately, and we may delete your data according to our data retention policies.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Texas, and you consent to the jurisdiction of such courts.

We reserve the right to modify these Terms at any time. We will notify users of material changes by email or through our services at least 30 days before the changes take effect.

Your continued use of our services after changes become effective constitutes acceptance of the new Terms.
